$23 Million Settlement For Tractor-Trailer Crash Victim and Family

Multiple Negligent Parties Held Accountable For Catastrophic Injuries

Partners Todd Johnson and Brett Votava obtained a $23 million settlement on behalf of a young Missouri man who suffered permanent, life-altering injuries in a collision with a semi-truck pulling a flatbed trailer. The settlement, which resolved all claims, was reached just weeks before trial in Missouri State Court.

The Incident

On November 2, 2022, a driver for a motor carrier attempted to make a left turn from a gravel county road onto a two-lane state highway in dark conditions. The driver was pulling an empty 48-foot flatbed trailer to pick up a load in the Kansas City area.

Visibility at the intersection was limited by a hill, and the driver knew the turn would take seven to 15 seconds to complete. The trailer, which had worn and faded reflective tape, presented a near-invisible barrier to oncoming motorists. Despite the hazardous conditions, the driver failed to use four-way flashers, a horn, or any other warnings to alert oncoming traffic.

At the same moment, the 29-year-old plaintiff was traveling to work. The glare from the truck’s oncoming headlights obscured his view as the trailer blocked the southbound lane. Unable to avoid the collision, the oncoming motorist struck the rear of the trailer at highway speeds.


Witnesses and emergency personnel reported devastating injuries. The plaintiff suffered a substantial brain bleed, multiple broken facial bones, fractured vertebrae, compound fractures to both femurs, a broken kneecap, broken lower leg and ankle, and permanent brain damage. Just days into his marriage, the firm’s client now requires 24-hour care in a long-term residential facility for the rest of his life.

Litigation and Findings

During litigation, Votava and Johnson uncovered critical facts about the roles of multiple parties. The first motor carrier had been subcontracted to pick up the load by a second, national motor carrier. This motor carrier held an exclusive transportation agreement with a construction supply company. The national motor carrier accepted the load, issued a bill of lading in its own name, and collected payment, yet delegated the work to the smaller carrier.

Outcome

The $23 million settlement provides long-term financial security for the family and funding for 24-hour care for the plaintiff. The case underscores VNJ’s commitment to advocating for victims of catastrophic injuries and holding all negligent parties accountable.
